
Documents Required To Sell A Spanish Property
Have all documents ready before marketing your property to avoid unnecessary delays that could disrupt negotiations or the sale process.
The list below may look a little over whelming but we will assist you collate all the necessary documents.
A lot of the documents are related to proof of ownership i.e. local tax, community and utility bills and receipts and the others will be obtainable from your original conveyancing lawyer or can be obtained by a newly appointed lawyer, I can help you appoint a new legal professional if required.
Decree 21/2005, enacted by the Andalucian government in 2006, sets stricter rules for property transactions and real estate professionals. It is now strictly enforced across the region. The law requires vendors to provide their real estate agents with specific documents before a property can be marketed for sale:
Bills and receipts
Receipt of IBI payment (annual property tax) – A bank receipt will suffice.
Receipt of Basura payment (annual rubbish collection tax) – A bank receipt will suffice.
Utility Bill - Electricity and or water
Community Info
Community fee payment recent (most recent) – available from your community administrator
Name and contact details of community administrators if applicable
AGM – Minutes and budget from the most recent community AGM
ID
Copies of Passports and/or NIE/DNI/TIE
Proof of main residence if living overseas - utility bill
Property Details
Copy of the title deed (Escritura)
Nota Simple (Within last 3 months) - Sol Simple can help obtain this.
LPO (Licencia de Primer Ocupacion) – First occupation licence or, due to its age, a certificate issued by the Town Hall that admits the habitability of the dwelling which is called the Administrative Building Certificate (CERTIFICACIÓN ADMINISTRATIVA DE EDIFICACIÓN).
CNI - CERTIFICACIONES DE INEXISTENCIA DE INFRACCIONES URBANÍSTICAS - This is a report issued by the Town Hall on the non-existence of urban planning infringements.
Floor Plan - If available
Signed Marketing Agreement (supplied by Sol Simple)
Touristic Rental Licence – If Applicable
Copy of National rental registry number (NRA / NRUA)
Copy of registration as a VUT/VFT tourist rental with the Junta de Andalucia.
